Legal Question in Credit and Debt Law in Texas
Liability for joint credit account after divorce
I have just learned that--name removed--ex-husband, from whom I've been divorced for 6 years, never closed the joint credit card account that we had while we were married. He is now out of work, owes almost 18,000 and wants to declare bankruptcy. How can I clear myslef of the debt that he has accumulated? I have not had a card on this account for over six years.

Re: Liability for joint credit account after divorce
This should have been done in the divorce. If your name is still on the account, the credit card co. will likely hold you responsible. When he takes bankruptcy, he will receive a discharge, unless you make a claim in the bankruptcy, perhaps for fraud. I don't know what your divorce decree says regarding this account, but it might be the basis of the fraud. You need a lawyer to help you with this, maybe the lawyer who got your divorce.
