Legal Question in Credit and Debt Law in Texas

Lien against homestead

I have received a letter from an attorney stating that they will be seeking a lien against my homestead for a credit card debt not paid. As I only have one mortgage on my property, I believe it is not open to liens. Please advise. Also, if they obtain a lien, can I then file bankruptcy to dismiss it? I have approximately 30,000 in unpaid debt due to a child custody matter 5 years ago and have just not paid these debts because I cannot do so. A lawyer told me a few years ago that I can wait to see what happens before filing bankruptcy.

Re: Lien against homestead

First, you're right...they can't file a lien against your homestead. If all you have is credit card debt, you don't need to consider bankruptcy. Call me at 713-932-1888 and I'll tell you how to get rid of a lot of that debt without bankruptcy.
