Legal Question in Credit and Debt Law in Texas

Loan Holders responsibility to inform

If i am 6 months past due on a 6000.00 loan, can the original loan holder send loan to collections without giving notification to me? In addition, It is a privately held student loan I acquired for an online school and I wanted to know if I could legally dispute the amount because the funds were not used.(i only took 2 classes, appox. $1500.00) The online school discontinued my major and changed its name. I know that I can have the loan validated and delay the collections process, but I would like to know if I have any legal footing on the dispute?
