Did this Luxury Retail Store obtain my Credit Report Illegally or with Good Caus

In Nov of 2003, I was shopping at a Notable Dept. Store in Houston, and wrote a check for $633.26.. I found out later they had ran my Full-Credit Report without any warning or permission in November of 2003. I knew they were concerned over some of my in-store returns that had been made, etc...

In January of 2004, I was arrested in their store for Shoplifting. I have a final disposition on this situation, a Class C Misd. thru a Plea-Bargain.

I did not know of the Credit Inquiry untill after the ARREST in Jan of 2004. No info was given to the Credit Bureau as to why they pulled my credit as required, and no permission was given by me.

My atty. is afraid of them as best I can tell, and won't research this. Their Attorney, sent a letter putting forth this explanation, they had the right to pull my full credit since I had wrote a check for 633.26, for a legitimate purpose back in Nov. 2003. This is the smoke they are saying. I beleive I was being investigated illegally. I did not give any permission to run my credit. Thank You for your time per this question. Finally, my arrest for Shoplifting makes this far more interesting in that I was being investigated by their Loss-Dept. The fact I shoplifted doesn't jutify their action.

The store's pull of your credit report was for a legitimate purpose under the Fair Credit Reporting Act; therefore, they do not need your permission.
