Legal Question in Credit and Debt Law in Texas
Mechanics Lien
My mechanic rebuilt my daughters transmission. The day she brought it home I drove it and it was not right. Returned it and my mechanic agreed that it was not right. He tried to find out what was wrong and could not. He told me to drive it right know. At 13,000 miles the clutchs burned up. He rebuilt it again. Less than 8,000 miles later, clutches burn up again. Took it back and when I called they said I owed $650 because they put in a ''good used transmission''. I owed because the first tranny had a 12K warranty. But it never worked and the 2nd only went 8K miles. His wife gave me the keys when I picked it up so I drove off. No work order was signed. (my daughter dropped it off). Can he file a mechanics lien after this. I spent $11K last year with him. Im not trying to cheat him, just want whats fair.I also recored our last conversation.

Re: Mechanics Lien
The lien is called a Garageman's Lien, and allows them to repossess the vehicle. Since repo fees run anywhere from $450 to $750, plus $15/day storage and no practical liability for any damage caused by the tow, it's best to pay what's being charged and then bring a claim in Small Claims for reimbursement.
