mechanic's lien

What right's do I have when my car is repo'd in the middle of the night and it is done over a 170.00 pair of tires.There was not any notification of a mechanics lien and now to get my car back I have to pay 1300.00 to get my car back.This happened last night. I am still paying on the car. Why wouldn't they just take the tires back. How are they able to take my car? How can I fight this?

If there was a notation on your bill of sale, your car was subject to repossession for nonpayment. Even if the proper notification was not on the bill of sale or invoice, it is better to go ahead and pay to get your car and sue them later. Because notice is being sent to your lienholder and they may retrieve it and then you have a much bigger problem. They are not required to give you notice of a mechanic's lien other than what is on the invoice.
