Medical Collections

My wife has bills in collections for medical bills that her insurance wouldnt cover. We do not have the funds to pay them and now an attorney is calling for payment. What can we do to fix this, the insurance company said they would take care of it but now they said the time frame to handle it has passed and we now have to pay it. This was through medicaid when my wife was pregnant. We do want to take care of this but we shouldnt have had to pay this in the first place when the insurance company said they were supposed to pay. again what can we do?

Hopefully someone with specific Medicaid knowledge will answer your question.

Usually a person is responsible for the medical necessaries even if there is insurance coverage. HOWEVER, somewhere in the back of my mind I think that Medicaid is treated differently. That in the contract between Medicaid and the health provider is a requirement to not try to collect the money from the patient, regardless of the amount of the final payment to the provider. If I am recalling correctly, Your responsibility is to provide proof to all parties, Medicaid, doctor, hospital, etc, that the patient was properly a Medicaid recipient at the time the service was provided. You should do this in writing, with a copy of her Medicaid letter dated at the time. Send it certified mail.

Again, I am not positive that my memory on this issue is correct, and hopefully a Medicaid lawyer will respond to your question.
