Misfiled Contract on Furniture Purchase

I recently purchased some furniture from a local furniture store. I was going to pay cash but the sales person talked me into financing interest free for a year.

It was delivered and I asked if there was a balance due. I was told No.

I never received a bill. I called the store, the credit department, the sales person, the finanace company, etc. and no one could tell me what was going on. They kept telling me that there was nothing in the system. I had no balance, no financing and were very rude to me and told me to stop calling. That really made me angry, so I stopped calling.

Last week I received a threatening phone call from a guy at the store telling me that they were going to press charges on me if I did not go back into the store and fill out new paperwork for financing. I've so far ignored him.

My question is, do they have any legal recourse against me since this was all their negligence. They lost my contract somewhere along the line and should have never delivered it with no financing contract and only the $500 that I had put down as a deposit w/o a COD? They also told me to stop calling them regarding the matter. I had every intention of paying them until they were so rude and unprofessional.

Their rudeness, or even stupidity, doesn't void your responsibility to pay the debt for the furniture you bought. Either pay them or refinance the purchase. Don't simply ignore them or you might find yourself on the wrong end of a lawsuit.
