named defendant in a civil /criminal case

what are Civil and Criminal consequences about an 8-9 years old credit card collection issue.Could not pay and forgotten as if it never existed.Amount under--name removed--$1000.Any statute of limitation applies or suggestions on how to resolve this issue,Should I delay the server who called to set--name removed--time to accept the papers. Please help.Thanks.

The statute of limitations for suit on a debt in the State of Texas is four years. Once it is past the statute of limitations, suit cannot be filed to enforce or collect the debt. The debt may be reported on the debtor's credit report for 7 years from the date of last activity. Thus, the debt cannot be collected from you and should not even appear on your credit report.
