Legal Question in Credit and Debt Law in Texas
Negligent Photographer
I hired a Photographer to take Wedding Pictures. He showed us wedding shots he had done before - ''very impressive'' and has done many weddings. We were assured that the quality of the pics could be blowing up to an 18 x 20 without it being grainy. I had no idea he does not know anything about taking pictures. Heads cut off, lots of ceiling shots, blurry/fuzzy shots. Only 3 shots of me and my entire dress, but they were blurry, the rest had the dress and/or veil cut off. Too many issues to list. After seeing the shots, there is no way he did the samples of pictures he showed us. He used a digital camera, but chose not to look though the viewer and obviously did not check the digital picture on his camera to confirm the pictures were any good. He took a lot of pictures from his hip, never kneeled to focus or frame his shots. The contract: 5 hours of photography, one security copy of your photos at the end of your event, one set of CD's containing all of your photos, 50 4 x6 print,8 8x10 prints and 18 wallets. Doctoring the pics, at best 25 can be used, there are still fuzzy ones. Only Recd security copy 1 month after wedding. What can be done?

Re: Negligent Photographer
Review your contract again. Is there any language regarding 'satisfaction' of services? If so, it will help your case considerably. Even if not, I would suggest you take your case to small claims court (JP) and sue for the return of your money. Although it is extremely sad for you that you now have no wedding portraits, you can not sue for additional damages, only the money you paid. You might want to review the contract to see if the prevailing party is entitled to attorney fees.
