Legal Question in Credit and Debt Law in Texas

notification of law suit?

I am currently 4 or 5 months behind on several credit cards I have been called by the banks and have not spoken to them. I listen to the messages left on my machine, I have not called back because I can not afford the payments they want and now I am starting to get rude calls from collection people who say my case in now going to court if I don't call them TODAY. my questions: do they have to notify me in writing about being taken to court?

Should I call them back? I do not have any funds to hire a lawyer for bankruptcy can I go to court with out a lawyer?

When a lawsuit is filed you will receive a citation with a copy of the filed lawsuit, delivered to you by either a constable or a private process server.

You can always go to court without a lawyer.
