Legal Question in Credit and Debt Law in Texas

Overzealous Creditors - Recourse?

I have about eight old (8 years) credit card accounts that get passed around to different collection agencies. Even though I have sent certified letters stating that I do not wish to be contacted further, I continue to be contacted by the same collection agency. Can I sue in small claims court and get them to stop and/or get damages? Thanks for your time.

Re: Overzealous Creditors - Recourse?

The short answer is yes, assuming that you haven't made any payments against the accounts over the past four years. That's covered under the Federal Fair Debt Collection Practices Act, and there are statutory liquidated damages for violations.

You may have a problem with venue, jurisdiction, and almost definitely collection upon any judgment you may receive.
