Legal Question in Credit and Debt Law in Texas
Owe a Credit Card Debt
I live in Texas and my mother contacted me that a constable was going to serve me papers for civil court. I contacted the courthouse and she told me to go pick up the papers or give new address of where they can serve me. She said she thinks it is for a credit card debt. She said when I get served I have to respond to it. What does she mean by respond to it? Am I going to have to go to court? I know they can't garnish my wages but probably get into my checking account. I get my Paycheck & Child Support Check directly deposited into my account. Should I change this process prior to the court date?

Re: Owe a Credit Card Debt
First look at the lawsuit and file an answer if it is for more than you owe...or includes penalties, inerest, attorney fees...but they cannot garnish wages before getting a judgment. If you have some other person on your bank account it makes it hard to garnish..if you change ..you have to change direct deposit etc...call a lawyer if the debt is large enough....we have had some success in reducing or eliminating such judgments
