Legal Question in Credit and Debt Law in Texas

We paid car payoff, and now loan office says that we still owe money

Several months ago, my husband and I had requested an early payoff amount for our car from a loan office. We paid the amount that had been stated over the phone as well as in a letter that we received that confirmed the amount. Since that time, we have received the title. A couple of days ago, we received another letter saying that we still owed $200+ in order to own the car and obtain the title from the lein holder. My husband called to find out what had happened. Apparently, the loan company posted someone else's payment to our account, and that was reflected in our payoff amount. We now have other financial obligations and are not able to pay that amount as requested. We believed that our obligation had been fulfilled. What are our options? Are we required to pay this amount despite the fact that we fulfilled the payoff amount stated in the letter?

You need to obtain the documentation that supports the finance company's position that a payment was incorrectly posted to your account and why you owe the $200. If an error was made, then you have not paid off the amount that you owed. Perhaps the finance company would accept a lesser amount since they are the one that made the mistake. But, first get the paperwork that shows how the error was made. If you want to talk to me after you have this paperwork, call me at 1-877-320-5232
