Legal Question in Credit and Debt Law in Texas

paid internet account in full but continue to receive bills

I paid out of my Internet access contract with an Internet provider in 8/2001 (have proof) but continue to receive letters/e-mails of monthly unpaid balances. I have letters from the provider confirming I owe nothing & wont be billed, but the billing continues. I call and complain every time it happens and they credit my account. They assure me it wont happen again then it happens again. Im frustrated and dont know what else I can do. Can I sue for harassment (letters/e-mails of unpaid balance) and/or punitive damages? It's continued for almost a year.

Re: paid internet account in full but continue to receive bills

Fortunately, or unfortunately in your case, there's no cause of action for computer-caused stupidity. You could file an action for declaratory judgment as to whether you should be billed or not, and possibly recover the attorney fees you laid out for the lawsuit. That's a bit like swatting flies with a sledge-hammer.

Write to them, certified mail, return receipt requested, telling them to sort out their billing problem and stop sending you invoices. Tell them that if they don't, and they report an unpaid balance to a credit agency, you will sue them for libel of credit. That may get their attention and resolve the problem.
