Legal Question in Credit and Debt Law in Texas

third party collection agency attempting to collect funds for a stolen check

A couple of years ago, some checks from my bank were mailed to my previous address. The checks were stolen and were written by someone that I did not know. I contacted my bank and the police when I received my bank statement. My bank assisted in creating affidavits of forgery for those checks that were received. The police located the person that wrote the checks but did not prosecute. About a month ago, I received a letter from a third party collection agencies law firm requesting that I pay to resolve an unpaid amount from a check number that falls within the sequence of checks that were stolen.

I contacted my bank, but they indicated that its been too long to create an affidavit. I do not know for certain if I ever received the check to have the affidavit created for that particular check. I have affidavits for checks up to and after the check number in question, and a copy of the police report that I filed. The police report references a range of checks that this one would fall within. What advice could you give me, so that they will close the issue? Thank you

Send a letter of explanation, with whatever copies of the supporting documents, and keep your fingers crossed.

The letter should go by certified mail, return receipt requested. Keep the certified mail chit, the green return card, and a copy of your letter with copies of everything you attached. That may come in very handy later.
