Legal Question in Credit and Debt Law in Texas
personal guarantee
i was a part owner in a texas corporation. american express sent to the company an offer of a credit card in the company name. i accepted the card offer, but never signed or accepted a personal guarantee. that was over 10 years ago. since then there have been other cards sent to employees and the other owners that i have not requested or guaranteed. now another owner has charged a large balance on this account and american express claims i have guaranteed the card because of the terms and conditions statement (like that comes in your statement) sent to the company. would there have to be an agreement signed for a personal guarantee? even if there were a personal guarantee, would there have to be a signed authorization by me to guarantee any other cards issued on this account.

Re: personal guarantee
Ask them to show you how you guaranteed the debt. Where is the language that AMEX relies upon to attempt to hold you personally responsible. Let me see that, then I can tell you something.
