pick up truck

my husband bought a truck for 400 dollars from a guy that lives about 6 hours away from us. well we sent the money and he told my husband that once he got the money he would send the title, well we sent the money in febuary and now its april and we still have not recieved the title. when my husband first talked to him about the truck my husband asked if he had a free and clear title and he said yes. well we found out that there is a lien on the truck. i was wondering what we needed to do about getting the title. because we have already gotten the truck running we had to buy a new starter. and also before we could get the truck the place that had the truck wanted the owner to let them know to release the truck to us.

You might be out of luck. You can sue the guy with the truck -- for the $ you paid him, and the unjust enrichment of him getting the truck back in better condition than when he gave it to you. You can also contact the lienholder, and negotiate a payout, and sue for that amount to obtain clear title.
