can we place a non-consensual lien?

Our x friend owes us money he wrote us a letter stating so.

we would like to put a lien on his house. Do we have to sue him in order to do that?

What if he has a homestead does that matter?

You would have to obtain a judgment on the debt resulting from your lawsuit. Depending on the amount of the debt, you might be able to file the lawsuit in the JP court. Your judgment lien could not be enforced against his homestead.
