Post Divorce Credit Card Debt Transfer to open Joint Account

I�m engaged to marry a wonderful woman who was married to the Devil. She has been divorced for over two years. Her Ex was laid off his $80K per year job and went to school for a teaching degree for a $30K a year job. He lived on his Credit cards. Problem is prior to his recent remarriage he transferred $36K post divorce debt to an open Joint Credit Card then filed bankruptcy. The Credit Card Balance was Zero at the Divorce and afterwards but neither my Fence�s lawyer nor herself verified the card was cancelled. Her only apparent recourse is to file personal bankruptcy or pay off his debt. This seems like it should be illegal. Is there any thing she can do to avoid bankruptcy?

That's a tough call without seeing the contract documents that first came with the card. Arguably that couldn't be a community debt since the community no longer existed, and the debt was zero when the community was dissolved. It may be worth fighting a bit before leaping into bankruptcy.
