Promissary Note Collection

Before my father died last year, he and my mother loaned my sister and her husband money a couple of years before...made payable by a promissary note. My sister and her husband are in the middle of a divorce in which the attorneys stated that my mom would have to go after the ex-husband on her own for his half of the money owed. He lives in CA, my mom in TX. Can she take action? Thank you.

Yes..your mother would be wise to contact an attorney experienced in collections...Normally the cause of divorce is "economics" and the ex may be judgment proof so most lawyers may just have your mother pay to get a paper judgement...
