Legal Question in Credit and Debt Law in Texas

Proper Dent Collections

We recetly attended a seminar for collections in the medical field. The man hosting the seminar said that if a debt is past due and we tried letters and collection agencies, and still no action or payment is made, that a doctor or office may file for a judgment. Which we know is legal.

The thing I question was when the host said that one the judgment is entered, a business can go to the police department and get a bench warrant and have the debtor arrested until the debt is paid.

I was unaware of any tort law that allowed for a debtor to be arrested for unpaid medical bills. My supervisor was shocked hwen she was told what the host said. Is the man giving proper debt collection advice?

That is unbelievably wrong. Debtor's Prisons went out in 1776.

If that was what the speaker said at the seminar, that certainly raises questions as to what other mis-information may have been given.

Holy Cow!

Your lawyer is a lawyer for a good reason -- she knows the law, and has common sense.

The speaker is either a moron, or evil.

In this country, and in this state, you cannot be imprisoned for a civil debt. Check out the Boston Tea Party, and related events.

You should file a formal complaint with whatever outfit hired this speaker.
