Legal Question in Credit and Debt Law in Texas
Okay, so my question is a very long one, but here we go:
About 9 years ago, my father rented some supplies to finish a bin he was building in Texas. He forgot to return the supplies and returned to South Dakota. The rental company contacted him about the supplies and he decided just to buy the supplies up front from the company. He asked his contractor to pay the company from his pay check, which the contractor never did. Since this time, we have filed bankruptcy.
Today, my father was pulled over and arrested because there is a warrant for his arrest in Texas due to this unpaid debt. They are sending him down to Texas for court.
We were never notified that the debt was unpaid. My father had assumed the contractor did what he had said he was going to do, and just paid the company with part of my father's check. This is the first time we have ever heard about the debt. It was never sent to collections either. Our address hasn't changed since then, so they were capable of sending us letters and never did so.
What are, if any, are our options? This just doesn't seem very legit to me.

First get a Texas Criminal lawyer..which we are not but depending on where he is going, perhaps we could recommend one..the charge is "theft"...and apparently there was miscommunication..but if he is still in SD..get a criminal lawyer there...don't rely on the fact he is innnocent...a lot of innocent people are in jail
