Legal Question in Credit and Debt Law in Texas

I received a citation regarding a law suit on a delinquent student loan. It requests a response to the Justice of the Peace within 10 day, however, it does not include details for the response. How do I respond? What do I include in my response? Payment arrangements?

First of all, you really need to talk to a lawyer. In certain circumstances, you'd want to file a special kind of answer.

But - assuming that you just need to file a general denial:

Type the "style" at the top of your answer - basically, it's the cause number, the "style" ("Big National Bank vs. Joe Smith"), and the designation of the court ("In the Justice Court of Harris County, Precinct 1, Place 2").

Underneath that, put "Defendant's Original Answer."

Underneath THAT, put "Defendant enters a general denial."

Sign it, with a signature block that includes your address and phone number.

Underneath that, put a certificate of service: "I certify that I have comoplied with Rule 21a."

Put a signature line under THAT, and sign there also.

File it with the court, and mail a copy to the Plaintiff's lawyer.

Do NOT mention payment arrangements - that has nothing to do with the lawsuit.

When you go to the clerk's office to file your answer (bring extra copies for them to file-stamp), pay the jury fee. Don't let them talk you out of this!
