In the state of Texas, it is not against the law to record a conversation if at least one person to the conversation knows that it is being recorded.

If you know how to get the tape admitted into evidence, then it will be one piece of evidence. Whether it is enough, will depend upon what evidence is on the other side, and how convincing the evidence it.
