Legal Question in Credit and Debt Law in Texas

remaining debts of dead relative

My mother in law passed away back in 09/06. At the time, she was in a nursing home.

When she died, she had a remaining debt of over $4,000.00, from meds, they were giving her. The debt went back as far as 04/06.

I didn't receive any bills on this till 10/06,when they were adding something else to her bill. I informed them that she had died.

Anyway to make a long story short, they have turned her bill over to a collection agency, that is

trying to get my husband and I to pay it.

Are we legally responsible to pay this bill ?

Thanks,

Sue

Re: remaining debts of dead relative

Unless you signed some document accepting responsibility - the answer is no. Send them a copy of the death certificate by certified mail and tell them to quit bothering you.

You are not legally obligated unless you signed something accepting personal responsibilty. They must look to your m-i-l's probate estate for payment.

Send them a copy of her death certificate.
