Legal Question in Credit and Debt Law in Texas

Repoed auto deficency collections

2 questions please.

1. John and Mary, brother and sister, both in Texas. Mary gets a judgement levied against her. Mary has John deposit her pay check in his account, he makes withdrawal and gives Mary cash. Is John's account reachable by Mary's judgement ?

2. Orignal creditor is Ford Mtr Credit. Collector is American Road Recovery in Mesa Az. American's wed site states '' incorporated by Ford Mtr Credit 1998 in Fla''. I didn't find reference to other states. Is American Road Recovery considered the original creditor and not subject to federal FDCPA ? If so, are they subject to Texas FDCPA?
