Legal Question in Credit and Debt Law in Texas

Request for Default Judgement

I filed a Small Claims case in January, 08 against an attorney's firm for non payment of an invoice. After contacting the court, I found that the ''Defendant failed to respond'', and that I could file with the court for a Default Judgement. They told me they had no specific form for doing this, but that a letter would suffice. Can someone give me advice on where to locate a form for requesting the Default Judgement, and what I need to do to make certain all goes well. I do not believe I received accurate information, as I was put on hold several times to get answers to my questions. Also, I would like to look professional in this matter, and I find it difficult to believe a simple letter to the court is all thats necesary. I live in Denton County,Texas. Thank you in advance for any help.

Re: Request for Default Judgement

Court personnel are forbidden to give legal advice but a simple letter will probably suffice....ask for a time to appear..and go get the default. Courts are not required to prpare judgments but most JP courts issue simple letter judgments.

Court personnel get many calls from people wanting help..and you may be on hold while they try to help others...Good luck
