Legal Question in Credit and Debt Law in Texas

Responsibility

I refinanced my vehicle and instead received my title and a letter stating my account was paid in full. I began receiving billing for the refinanced amount but it had no balance due on it. Am I still legal responsible to pay or was it their error. I sent a payment in with final payment written on it. If they accept the check as payment are they required to accept that as the final payment?

Re: Responsibility

You are responsible, even though they made an error.

The "Payment in full" is applicable only where there is a bona fide dispute over what's owed. You don't have that situation here.

Remember, your refinanced note is accruing interest for which you'll be responsible when they get their paperwork sorted out.
