Legal Question in Credit and Debt Law in Texas

Who's Responsible

A previous employer set up a charge account that I was authorized to use to purchase supplies, etc. for his ranch. He would pay me and I would pay on the account. My name was placed in the billing address instead of his after about a year. He stopped paying me so I stopped paying the bill. Now an attorney has sent me a ''delinquent account'' letter stating that I pay the balance or he will take me to court, and I will also incur legal fees and court costs. After requesting proof from the business which held the account of the responsible party who set up the account, none has been supplied. Am I responsible??? Can they collect this from me?

Re: Who's Responsible

You are not responsible, but you may have to prove that in a lawsuit. Unfortunately, if the account showed "Bill to" and your address, there's a legal presumption that the account is yours. That presumption can be rebutted, but it will not be easy.
