Legal Question in Credit and Debt Law in Texas
Tried to return auto after becoming active duty & sent to Iraq
My son was a reserve and called to active duty in Iraq. He no longer needed the automobile he bought about 3 months before and could not afford it. He asked the dealer where he bought the car if he could return it, but was turned down. We tried to sell the car, but couldn't. The vehicle had about 500 miles on it and in perfect condition. I asked that the dealership pick the vehicle up, and after approximately 2 months, they did so. I haven't checked, but I feel confident that my son's credit rating has been affected by this event. Is there any way to fix that? He will be coming home in March and will be looking to purchase a home.
Thank you so much for any information you can provide me.

Under the Sailor and Soldier Relief Act, a creditor may not repossess a vehicle of a person on active duty without a court order. Sounds like he may have a claim under the Act.
