Legal Question in Credit and Debt Law in Texas

Roommate demanding money from me

This is the situation. I was on vacation last year. When I returned home I found that my roommate had moved out. He never informed me he was moving out, nor did he inform the apartment complex that he was moving until after he had actually moved out. As a result, I had to scramble and move out because I could not afford the entire rent payment myself. We were on a month-to-month lease, but the apartment complex requires a 60 day notice of intent to move out. Because of the situation the apartment complex was not given the 60 day notice. As a result, of not giving the 60 day notice the apartment complex demanded that my former roommate and I pay for two months rent. I never recieved any notification of this from the apartment complex. However, my former roommate recieved a letter from a collections agency demanding payment. I recently recieved a certified letter from him saying that he paid the entire amount, settling the account, and demanding that I pay him for half the amount he paid. He paid the amount owed without speaking to me about it first. Therefore, I never agreed to reimburse him. Do I have to pay him back. He is threatening to take this to small claims court.

Re: Roommate demanding money from me

If you are sued in Small Claims, he'll probably get a judgment against you. That will trash your credit, and you'll owe him plus court costs.

If you were both on the lease, then you should split the cost. You are responsible for your portion of the rent whether you were there or not.
