Legal Question in Credit and Debt Law in Texas

sale of house in another state

My husband & i have been seperated since oct. 2007. We are in the process of selling our house in texas and have run across one problem after another. He lives in california. The lady that is buying the house got a complete title search done and we found out that his wife that passed away in 1998, didn't leave a will to him, so one half of the house belongs to her 3 kids. 2 of them have signed off the deed, but having a problem with the youngest son. The question i have is, my husband just up and left on oct. 31, 2007 and didn't tell me. Cleaned out his bank acc. And left. We are suppose to get $40,000 for the house, and i told him i wanted $25,000. Now, if he doesn't give it to me, can i sue him for desertion? He is going to texas next month to get the final dissilution done, and i want a check issued to me seperate from his. We never got around putting my name on the deed to the house when we got married in 2000, but i should still be entitled to the $25,000. Thank you for your time.

Do you have a lawyer? If so, you need to be addressing these concerns to your lawyer.

If not, I can't imagine why not. You are risking large amounts of money. Especially if he is going to Texas to get a court order, without you present.
