Legal Question in Credit and Debt Law in Texas

Secondary Sigener Rights

Last year a friend and I purchased a vehicle together and I am listed as a secandary signer. Well she as since moved to another state and assumed responsibility over payments and maintenance...ect. Well before she left we made a written agreement that she would work towards getting the vehicle refinanced. Well she hasn't made any efforts and this months payment is 13 days late. Because we have a written aggrement could I take her to court to have a judge set a time frame for her to attempt to get the car refinanced...

Re: Secondary Sigener Rights

You can certainly take her to court, but the judge is not going to set limitations or restrictions on her payments, but can order that she pay a judgment to you, once you repossess the car and sell it.
