Legal Question in Credit and Debt Law in Texas
I have been served with a citation to appear in district court. I am being sued for an old credit card debt. I have never had any dealings with the suing entity. I need to file a written response and need to know how to do so (the form it should take)
1 Answer from Attorneys
Try a format like this (for your answer):
----------------------
No. 09-30007
Credit Card Guys | In the District Court
|
vs. | 301st District Court
|
Me | Dallas County, Texas
DEFENDANT'S ORIGINAL ANSWER
TO THE HONORABLE JUDGE OF SAID COURT:
COMES NOW
1. Defendant denies each and every, all and singular, the allegations set forth in Plaintiff's Original Petition and demands strict proof thereof by a preponderance of the credible evidence as is required by the Constitution, statutes, laws, and Rules of Civil Procedure of the State of Texas.
WHEREFORE, PREMISES CONSIDERED, Defendant
[Signature line (name, address, and telephone number)]
[Certificate of service ("I mailed a copy of this to the Plaintiff's lawyer on December 7, 2009")]
----------------------------
And when you file this with the clerk's office, PAY THE JURY FEE. It will be $30 (at most), and it's worth it.
You'd be better off if you consulted a lawyer, in case there are defenses such as usury or the statute of limitations.
