Sold A Car To A Deadbeat
Last week, I sold my 14 year old car to a person I don't know who lives in my complex. I sold it for $800 and drew up a contract that she would pay $300 down then $250 in one week and the remainder in a month. The day she was due to pay the 2nd payment, she left a message on my voice mail that the car broke down, she wouldn't be paying me anymore and I could keep the $300. She said she'd have it towed. It's been 2 days and I haven't received my car or any money and now she is avoiding me and won't return my messages. Can I sue her for the remaining money? I have a signed contract that she is responsible for payment or I will take the car back. I have no idea where the car is. Can I contact the police and report it stolen? How long should I wait before I can take legal action? I was relying on her payment to pay my electric bill and now can't afford it. I am an individual, not a car dealer. Thank you in advance for any advice.

I understand you are in a bad situation, but you can't report it as stolen, because it isn't. You can however, go to the JP and file suit against her. It will cost you (unless you are indigent -- ask the clerk for a form) -- and you can ask for the damages and costs. Good luck. TC
