Legal Question in Credit and Debt Law in Texas

Spouse ruined credit

I am in the process of cleaning my DH's credit. His exwife left him with over 21 medical collections and several credit cards that she took out in his name without his permission. She is bipolar and has done identity theft to him and others. What are our rights here regarding the debt. I am sure she won't help us pay them. She would go to the ER and get shots 5 or more times a month and we have those bills now. Is he responsible for all of them? Just in one county here in Texas she has 19 criminal cases against her and there are tons for hot checks. We also have several letters from merchants for her hot checks she wrote. I thought that just because the are married, unless it is a neccesity, that a spouse does not act as an agent for the other spouse solely because of the marriage relationship. What are our options here? Thanks for all your help in advance.

Re: Spouse ruined credit

In Texas the debts of a spouse is considered a community debt where both are liable, unless the lender has specifically stated in writing that they will only look to the credit of one spouse alone.

One spouse is not responsible for bills run up by their ex after divorce.

You are not responsible for debts in your name procured by someone else through fraud, unless you gave them the opportunity to do so.
