statute of limitations/credit card lawsuit
Served with papers, being sued by credit card company; credit report says acct closed 08/02.says type acct is revolving; statute of limitation in Tx, 4 yrs. This citation dated 12/27/06. Past the statute of limitation; can they sue me? do I have to appear? have only a few days left to respond to citation;

The citation date doesn't control. What was the date the lawsuit was filed? If before 08/02 you don't have an SOL defense. You must make answer or they'll take a default judgment against you.

SOLis a defense that you must plead & prove.
