Sub-contractor trying to collect from prime contractor on a government contract
i'm a subcontractor providing manpower and materials on a local government contract. my company agreed to take over the contract from the primary contractor for the duration of the contract around mid-2002.we are fulfilling our end of the bargain and suppling everything needed for this contract, but have not been paid since August 2001.we are not on the government contract and are only representing ourselves as an employees of the primary contractor.the primary contractor is suppose to notify the agency of any subcontractors prior to any outside company doing any work,but has not complied. what can i do to collect my money from this primary contractor? they currently owe our company 75,000.00

You could sue for breach of the contract between you and the prime and obtain an Order of the Court requiring him to comply with the notice requirements. If you want my assistance in this matter, contact me via e-mail.

Immediately contact the contracting officer for the governmental entity, and the bonding company that bonded the prime contractor, and state your case. The contact has to be by certified mail, return receipt requested. Show where you've demanded payment from the prime, and enclose copies of your unpaid invoices. You may be able to receive payment either from the government, or from the surety. Other than that, your only hope is to sue the prime for breach of contract. If you are still working on the project, you may also have to sue the surety.
