Legal Question in Credit and Debt Law in Texas
Can I sue the ex?
I have learned that my soon to be ex has put me in debt with credit cards and bills up to $50,000. We separated on Dec. 24, 2006. The ex filed bankcruptcy in 1998 and used my credit cards and name for everything. We were married for 30 years and have 3 grown children. My youngest is 18 and going to college this fall. The creditors are calling me and I tell them to call the ex and the ex tells them to call me. What can I do? Also, my 3 sons are asking if we pass away any time soon....are my 3 sons held liable for all the debt that my ex and I owe? Thank You

Re: Can I sue the ex?
Your sons will not be held liable for your debts.
I assume that the credit card debt was incurred after the bankruptcy and before the divorce. First, you'd have to look to the agreement made part of the divorce decree to see who would be responsible for the credit card debt. If he's responsible, or the agreement is silent on that point, you can sue him.
