Legal Question in Credit and Debt Law in Texas
sued by cc company
I was sued by a credit card company. 6 years ago I had major financial issues and the amount I owed was about $8,000. I was unable to pay and it went to collections. 1 year ago they sued me and 2 days ago I received a letter stating tha they won and the judgement is for over $22,000 now. If I do not contact them then a Sherriff will come and serve me with a Writ of Judgement. I do not have the money to pay them, I don't own anything. What can they do to me? Will I go to jail for this?

Re: sued by cc company
If it went into default 6 years ago, the statute of limitations has passed. The statute of limitations for suit on a debt in Texas is 4 years. You should hire a lawyer to defend it, because you have a claim against them for violating the Fair Debt Collection Practices Act by filing a suit outside the statute of limitations.
