Legal Question in Credit and Debt Law in Texas
being sued for a credit card by a collection agency
MY Husband had a credit card that he wanted to close and make monthly payments on until it was payed off. The credit card company hiked up the minimum payment by two hundred dollars when some law that bush passed came into effect. We could not make the minimum so asked if we could be set up on a payment plan. The lady we talked to refused to set anykind of monthly plan up, called my husband a few choice names, he asked to speak to a supervisor was refused by her several times, and was refused several times after that on different attempted calls. We sent in a check for the minimum amount but the check was sent back with a letter stating that they wanted the full amount on the account. He explained to them that this was possible and tried again to set up a payment plan with the compnay but was refused they wanted to total amount. We never recieved another statment in the mail, which had been three years ago. At the beging of January he was served with papers to appear in court because some collection agency is wanting the money plus court cost, and other random charges. What do you do when this happens

The bestest thing would be to hire an attorney. It's not practical to go into the possible defenses in this response.
