Legal Question in Credit and Debt Law in Texas

Being sued for a credit card debt.

I am being sued for a credit card debt that is mine, however I am unable to pay it. I have been looking up information on this site about how to answer the suit, since denying it would be wrong. Can I wait to file my written answer on my court date day, and can I include in the answer that I would like for the court clerk to create a payment plan with the attorneys?

I am aware that this particular lawyer rarely shows up for the court dates and I might be able to get the case dismissed?

I don't know why denying the debt is wrong. Do you know absolutely, positively sure that they did everything right and all the calculations are correct? Next, the court clerk nor the judge nor anybody in the courthouse is going to make the creditor do a payment plan with you. You can go to court and ask to have the suit dismissed if the attorney is not there. Good Luck.

You are like most of us..we want to pay what we owe..BUT you presume that what is being asked for is owed..hence, all lawyers respond to claims against their clients.."we generally deny the allegation and demand strict proof thereof.:" As the Plaintif has to prove the claim.

And then if you go to Court..you MAY be able to negotiate with the laweyer BUT the Court has no duty, nor should the Court negotiate for one..The Court is a fair judge of facts and law..not to settle cases..If the debt is substantial, call a lawyer for help
