sued by discover card for year 1997 account
My parents opened a discover card account in '97 By'99 they placed their finances with a consumer credit counseling agency.The Discover account was no longer used. Soon after finishing their balance with this agency Discover card started calling saying they had a balance of nearly $2000, and would they like to settle for a fraction of original debt. This matter was never resolved. This Dec 2005 they receive a letter stating they are being sued for $6000 debt and past interest and need to file a written answer within 20 days. Who can we consult about this what laws came into effect this year? What does the letter have to state and how do I make it ''legal''? Please help

If you don't want to hire a lawyer, these forms are available at your local law library and in many public libraries. They are also available online.

Your parents had best hire a lawyer to respond.
If nothing else, their letter to the judge should state that they dispute the debt and that the statute of limitations has run. Send a copy of the responding letter to opposing counsel as well as to the court. Then they should go to the form books at the county law library, as Mr. Grissom has suggested.
