Legal Question in Credit and Debt Law in Texas
Being Sued over $1,221.08 hospital bill
I received a citation last evening notifying me that I am being sued for a past due hospital balance from 2005 and I never received a notice about this from the hospital. There is no court date on here. It says a default judgement may be taken against me. What is a default judgement? What happens if I don't respond? I do not have the money to pay it anyway? Please let me know. What are the SOL in Texas?
Thanks,
Cheryl

a default judgment is for the full amount plus attorney fees..so probably $3000 or so...but the judgment remains on your record, can prevent buying or selling..etc..so send a written denial of the accuracy of the bill..and swear before a notary public the bill is not true and correct..then when set, appear...and argue as the balance is probably from a beefed up bill ie $5 for an aspirin, etc.. and SOL is 4 years so also plead SOL...
