Legal Question in Credit and Debt Law in Texas
I'm being sued by a JDB.
Fighting a TX. c.c. lawsuit. I received a summons w/ Request for admissions questions. I disputed the debt in writing 4'07 within the 30 day time frame. I asked that they provide me with all past communications and account summaries reflecting the correct balances due. Explained I was still willing to take care of this situation if I rightfully owed it . They sent me a partial computer generated ''Transaction History''. On 5-30-08, I again disputed the debt and asked for verification of the debt,the original contract that I signed and dated ,agreement info,credit limit,all correspondences associated with the acct. Asking for a complete account of the alleged bill. Stated I would fight this , that I can't afford my bills now, more less something I don't owe by law. No response except lawsuit. This is on my CR as verified but the dispute is noted. Have JDB & CRA violated my rights? Do I demand validation again from both? I didn't state their time limit in either dispute letter. Can the plaintiff be assignee, owner & beneficiary? It states this and on the court facts. The demand letter says they are the original owners and I Know I never opened an acct. with them. I did have one with another co. yrs prior though. If the same sold 3x

File a sworn denial..attach your letters..and answer admissions or they will get a judgment. No you do not have a claim against them unless you do not owe the debt..then you may be able to counter for unfair debt collection...but without seeing pleadings, it is hard to advise you
