In texas can they levy a bank account after a repossession of a vehicle on the balance after it sold at auction.when can they garnish a payroll check.

If they get a judgment against you, they can garnish your bank account. They have to sue you, get you served, and get a signed judgment first. Garnishment is a "post-judgment" remedy. If you haven't been sued, then they can't garnish your bank account.

They can NEVER garnish your paycheck for an ordinary debt. Paycheck garnishment is for

1. child support.

2. spousal support.

3. back IRS taxes.
