Legal Question in Credit and Debt Law in Texas
Threatened to be sued for $1104.00 debt to Creditor
I lost my job in Dec. 2001 and have yet to find another. Over the last 10 months, I have struggled to make payments to various creditors while also raising two children. One of my accounts was established through my last employer for expenses that were to be paid off on a monthly basis. At the time of layoff, my balace was 1400.00. Although I paid an amount each month to show responsibilty for payment, the creditor did not find that sufficient and sent me to collections in May of 2002. There I was set up on a payment plan and was able to make two payments of $139.00. I have now run out of money and can barely pay my rent and utilities. I have missed Aug. and Sept. payments and while I have kept in close contact with the creditor they have threatened that on the 25th of Septemeber, they will pursue legal action if payment is not received. Can they do this?

Yes. Being unable to pay is a reason, it is not an excuse.
