Legal Question in Credit and Debt Law in Texas
threats from lender
after going thru a very bad divorce last yr and loosing my credit and then my job, I became unable to pay my bills. I was always behind up to the date of loosing my job, just managing it seemed to pay late charges. The lender I have my furniture financed with has called and is now threating to file charges against me with the District Attorneys office. Im not employed at this time but the thought of be involved with the D.A.s offices isnt something that I want. Can they do this to me? Theres no way I can make the full payments and Im always behind? I wont sleep much till I know the answer. Please Help!!

Re: threats from lender
They can't file criminal charges for a civil debt. Rest easy on that. However, they may be able to legally repossess your furniture, if your contract with them gave them that right, or if the furniture is collateral for the note.
