Legal Question in Credit and Debt Law in Texas

uncollected debt

I had just received a letter from a debt agency wanting to collect on an ''unpaid'' bill that supposedly was incurred in 1996 in Texas. I was not aware of that bill and thought that all medical bills were paid. I had called the agency and they informed me that it has been reported to the credit agency. Is there a statute for collecting this bill? I had health insurance back then while working for a firm that is now no longer in business. They want me to pay the bill first and then find proof of payment or insurance afterwards.

Re: uncollected debt

Pennsylvania has a six-year statute of limitations. Write to them certified mail, tell them it's too late, and to remove the report from your credit record, since that seven-year reporting period has also passed.

If they balk, contact a lawyer in your area that's familiar with the Fair Debt Collections Act and the Fair Credit Reporting Act. The agency and their principal may be on the hook for statutory penalties.

I agree with Peter. PA's statute is 4 years on Contracts, but Texas law on the length would apply.
